Introduction

The "LifePulse" application operates by offering services under the following terms of use, which constitute a legally binding agreement between the users and the manufacturers and administrators of the Application. The application is managed by "LifePulse", with representative name: Panagiotis Karadaglis, email: support@lifepulse.gr, phone: +30 69 8382 1709. By accessing and using the Application with these Terms of Use as well as the Privacy Policy. The terms of use may be modified and users will be informed of the changes and if they consent and agree to the modified terms/conditions they will still be able to use the Application. The modified terms will come into force from their publication in the Application or on the website [www.lifepulse.gr]. Any access to or use of the Services following the posting of the amended terms constitutes your acceptance of them.

Object of Services

The "LifePulse" Application provides users with a platform through which the contracted Hospital Services announce blood needs and users receive the corresponding notification to meet those needs if they so desire. Access to the services of the Application does not entail any cost, access to the Application is free.

Registration and Use

You can only use the Application if you have registered. This is done by filling in the required information on the registration form provided. If using the application as a Hospital Service Manager the forms are different from those of blood donors. For blood donor users: Only persons with full legal capacity can register as blood donors. For Hospital service managers, only those who meet the terms and conditions arising from the respective agreements between Hospital services and LifePulse can register. By registering on the Application, you agree to provide true, accurate, complete and up-to-date information about yourself. If this information does not correspond to reality, there is a possibility that your registration will not be accepted, suspended or terminated immediately. This applies to both blood donor users and Hospital Service managers. Users of the application are responsible for all operations carried out under their personal password, username and account. In cases of unauthorized use of their account and any security breach, members agree to notify us immediately at support@lifepulse.gr. Users can correct their registration information at any time, in accordance with these Terms of Use and the Privacy Policy via the app's settings menu. For blood donor users: 1. Medical data, 2. Location, 3. Name.

Limitations and Obligations

Visitors/users must respect the restrictions disclosed in these terms of use and in national, European and international legislation. Thus they expressly agree that they will not use the application in any way that may hinder its effectiveness and damage its reputation. They will not use it to transfer files containing viruses, trojans or other harmful programs, to access other users' accounts, to violate security measures, to spread defamatory or threatening content against one or more people or a group of people.

User/Visitor Exclusion

We reserve the right to exclude a visitor/user from the application's services or their access to it as well as to delete their profile, in case it does not work in accordance with the present terms and conditions of use of the Application as well as in accordance with the national, European and international legislation. In such a case, the warning of the user is not required while we reserve our right to exercise all legal means against the visitor/user in cases of positive and collateral damage that we may have suffered.

Suspension of Operation and Discontinuation of the App

We expressly state that it is at our discretion to temporarily suspend or terminate the use of the Application and the services contained therein at any time and without reason. In case of interruption or suspension, the user/visitor is obliged to immediately stop any use of the Application and its services as well as to destroy any material collected and originating from the Application. We hold no obligation to any third party for any termination or suspension of the Application.

Governing Law and other Terms

These terms of use and conditions constitute a contract governed by the provisions of Greek and international law as well as by the directives and regulations of European law. At the same time, the rules of good faith and commercial ethics apply. In the event that any of the conditions is deemed illegal, invalid or voidable, it automatically ceases to be valid without affecting the validity of the other conditions. Competent courts for any disputes are the courts of Thessaloniki. If any user/visitor encounters or finds any problem with the operation or content of the Application, please contact support@lifepulse.gr immediately.

Intellectual Property Rights

The content of the application and more specifically the trademarks, logos, symbols, website names, industrial designs, images, texts, of the software, originating from the Application are protected by intellectual property rights and belong to the manufacturers, creators and administrators of the Application. The intellectual property on the software may not be used in any way and in any medium without the prior written permission of their owners. The services of the Application are available solely for your personal, non-commercial use. The manufacturers and managers of the Application bear no responsibility for damages that may be caused in case of copying, transfer, distribution, similar, protected content used in the software, in violation of third party rights.

Limitation of Liability

The developers and administrators of the Application are not responsible for blood donors for any issues that arise during blood donation. All information published in the Application is that provided by the users. Users are responsible for providing their correct, valid information and self-reporting of their availability for their appearance in our software. We will not verify whether, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including obvious and typographical errors), inaccurate, misleading or untrue information or non-delivery of information. Users retain responsibility for the accuracy, completeness and correctness of the information about them that they enter in the Application.

Expiry

The developers of the application may notify, suspend or even terminate the account of a user, while taking appropriate legal measures in the following cases: (i) when the user violates any of his obligations arising from this agreement, (ii) if a user uses fraudulent practices or fraudulent acts, or (iii) if the user's actions have caused or may cause harm to third parties or the Application. There is no right to compensation for the user in case of termination or suspension of his account. The makers of the Application retain the discretion to modify, discontinue or suspend the provision of its services, with or without notice for the reasons mentioned above and will not be liable for any damages or losses that may result from them actions.

Maintenance and Support

The makers of the Application reserve the right to release upgraded versions of this Application and may automatically upgrade the online version of the Application that you use on your mobile phone or computer. By accepting these terms you consent to this automatic upgrade and agree that the terms of this agreement will apply to any such future upgrade. However, manufacturers have no obligation to provide support, maintenance, upgrades, conversions, or new releases under this agreement.

Privacy

All relevant information regarding the collection and processing of users' personal data, users are referred to the Privacy Policy, which is an integral part of these terms of use.

Final Provisions

These terms and conditions of use constitute an agreement between the user and the makers of the Application with respect to its subject matter and supersede any other instruments, agreements, documents, contracts, oral or written agreements between the parties that occurred prior to the date of registration you as a user. If any provision of these terms and conditions is or is held to be invalid, unenforceable or non-binding, the user remains bound by all other provisions hereof which are expressly agreed to remain in effect. In such event, an invalid provision will be deemed enforceable to the extent permitted by applicable law. Also the user agrees that in such a case he will accept another provision with a similar force to the invalid one, taking into account the content and purpose of these terms and conditions. The unenforceability of one of the terms of this agreement does not affect the right of the developers of the Application to enforce such a term thereafter. The user is not obliged to use the Application after registration and can choose to stop using it at any time.
